ESTATE PLANNING AND Probate

Washington’s probate procedures can be streamlined and efficient IF your estate plan documents follow a few important rules.  Many lay people miss these rules when drafting on their own. While I may recommend that you consult a website to save lawyer fees, you must also promise yourself, your family and me to CONSULT AN INDEPENDENT ATTORNEY afterwards, and bring any draft documents with you.  Also, if something goes wrong with an estate, or a friend or relative suffers suspected theft or abuse, then an experienced attorney is often essential. The following cases, listed with case numbers for access at Superior Court websites, are examples of where I was able to stop abuse or recover funds, sometimes with the help of law enforcement: L v. GUARDIANSHIP                                  

Since guardianship limits the liberties of a living person to act on their own, our system provides guardianship with special rules to protect liberties and property.  The rules apply when establishing a guardianship or for acting guardians.  So even if you use the required forms for guardianship published by the courts, it is practical to have an attorney’s help, especially when you might suspect abuse or exploitation of an incapacitated person.   Not only have I investigated over 75 pending guardianships to make recommendations to the Court, but I have also helped stop abuse and exploitation in the guardianship context, like other probate cases. Since guardianship is largely confidential, example cases are not listed here. However, I am ready to discuss the special remedies and analyses that help stop abuse or recover monies to see if they could help your case.

 


ADDITIONAL PERSPECTIVE                                     

I have assisted with a variety of civil cases for over twenty years, and have the uncommon distinction of briefing several important family law questions that have resulted in published decisions by our appellate courts.  See King v. King, 162 Wn.2d 378 (2007); Marriage of Rusch, 124 Wn.App. 226 (Div. I, 2004); and Marriage of Foran, 67 Wn. App.  242 (1992). I have also assisted with emergency protection orders and the difficult processes of deciding to take a case to trial, discovering hidden assets, and heart wrenching conflicts over children.  While I favor quick action to discourage exploitation, abuse or even violence, I also favor settlement, mediation and use of social service supports as much as possible.
